Case Background:
A driver of a motorcycle was injured when the car in front of him changed lanes in order to avoid the accident, requiring the motorcyclist to swerve, causing him to fall. The property damage was determined as a total loss. The physical impact was severe and our client spent a week at the hospital.
Challenge:
The main challenge was because there was no impact between the car and the motorcycle; the car drivers insurance company did not want to pay for any damages. The only choice available was to go against the insurance company and fight for our client’s best interest. The insurer argued that the accident happened as a result of the motorcyclist’s negligence. We hired an expert and were able to prove that, according to the skid marks on the road and the location of the bike, the accident could have only happened as a result of the negligence of someone else and not our client.
