Case Background:
This case involves a cyclist in his mid-40s who was struck and injured by a vehicle while commuting to work. While biking through the area’s tree-lined neighborhood paths, the cyclist emerged onto a stretch of open road. He approached an intersection as a speeding car approached from an oncoming direction. The car did not stop prior to turning the corner and collided with the cyclist.
The cyclist, who was wearing a helmet, sustained significant injuries to his legs and arms, including broken bones and deep muscle trauma. The bicycle itself sustained structural damage to its frame after the initial impact and falling to the pavement. The cyclist required hospital treatment and extensive physical therapy following the accident.
Challenge:
A lack of eyewitnesses made it difficult to establish the details leading up to the accident, including where the cyclist was in the intersection and whether he signaled his intent to cross. However, the physical evidence left behind allowed attorney Fedor Kozlov to illustrate the force of the collision and the driver’s negligence in observing traffic laws, including ignoring the posted speed limit and stop sign.
Result:
The ICML team assisted the cyclist in achieving just compensation from the driver’s insurance company to cover medical treatment and property damages. The victim was able to receive appropriate medical care and repair his bicycle with the claims money he received, and he is now back on the roads for his morning commute.
